Terms of Service

These Terms of Service ("Terms") govern your use of caprecruiting.com (the "Service"), operated by Collegiate Athletic Planning ("CAP Recruiting," "we," "us"). By creating an account or using the Service, you agree to these Terms.

1. Eligibility

You must be at least 13 years old to use the Service. Users under 18 should have a parent or guardian review and consent to these Terms. By creating an account you represent that the information you provide is true and that you have authority to enter into these Terms.

2. Accounts

• Players, coaches, and admins all register with a unique username and email.
• You are responsible for safeguarding your password. Notify us immediately of any unauthorized use.
• Coach accounts require an admin-issued invite and verification of coaching affiliation.
• One person per account. Do not impersonate anyone or misrepresent your identity.

3. Subscriptions and Payment

• Players choose a paid subscription tier (Essentials, Advanced, or Premium) to create a profile. Coaches use the Service at no charge.
• Payment is processed by Stripe. By subscribing, you authorize Stripe to charge your chosen payment method on the billing cycle you selected.
• Subscriptions renew automatically until canceled. You can cancel anytime via the Stripe Customer Portal.
• Unless required by law, payments are non-refundable. You will retain access to paid features through the end of the current billing period after cancellation.
• We may change pricing with at least 30 days' notice. New pricing applies to the following billing cycle.

4. User Content

You retain ownership of the content you upload (photos, videos, transcripts, messages, profile text). By uploading content to the Service, you grant CAP Recruiting a non-exclusive, worldwide, royalty-free license to host, display, and share that content solely in connection with operating and promoting the Service. You represent that you have the right to upload everything you post and that it does not infringe any third party's rights.

5. Acceptable Use

You agree not to:

• Upload content that is illegal, defamatory, harassing, sexually explicit, or violates any person's privacy.
• Impersonate another player, coach, or institution.
• Scrape, crawl, or bulk-download Service data without written permission.
• Attempt to bypass tier-based access controls or payment requirements.
• Use the messaging feature for spam, solicitations unrelated to recruiting, or unauthorized promotions.
• Interfere with, probe, or attempt to compromise the security of the Service.

6. Coach Messaging

Direct coach-to-player messaging is reserved for Premium-tier players and is subject to rate limits. Abuse of messaging — including harassment, recruiting violations, or unsolicited commercial content — will result in suspension.

7. NCAA, NAIA, and Amateurism

CAP Recruiting is an information and communication platform, not a recruiting service regulated by the NCAA or NAIA. It is your responsibility to ensure your use of the Service complies with any rules applicable to your eligibility, recruiting, or amateur status. We do not provide legal or eligibility advice.

8. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any reason we consider necessary to protect the Service or its users. You may close your account at any time by contacting us. Upon termination, your access ends immediately and your profile is removed from public directories; paid time remaining in a billing cycle is not refunded except where legally required.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or that any coach will view, message, or recruit a given player. We are not responsible for decisions made by coaches, schools, or other users based on profile content.

10. Limitation of Liability

To the fullest extent permitted by law, CAP Recruiting and its owners, operators, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of recruiting opportunity, scholarship offer, or goodwill arising from your use of the Service. Our total liability for any claim arising out of or relating to these Terms or the Service will not exceed the amount you paid us in the twelve months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless CAP Recruiting from any claim or demand — including reasonable attorneys' fees — arising out of your use of the Service, your content, or your violation of these Terms.

12. Governing Law

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-law rules. Any dispute will be resolved exclusively in the state or federal courts located in York County, Pennsylvania, and you consent to personal jurisdiction there.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be announced via email or in-app notice. Continued use of the Service after an update constitutes acceptance of the updated Terms.
